Introduction

This website is operated by PACF Digital Ltd. Co. Throughout the site, the terms "we", "us" and "our" refer to Montcleaf. Montcleaf offers this website, including all information, tools and services available on it, conditional on your acceptance of all terms, conditions, policies and notices set out here.

By visiting our site and/or making a purchase, you engage in our "Service" and agree to be bound by these Terms of Service, including any additional terms and policies referenced here. These Terms apply to all users of the site.

Please read these Terms carefully before accessing or using our website. If you do not agree to them, you should not access the site or use our services.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services.

Section 1 – Online store terms

By agreeing to these Terms, you confirm that you are at least 18 years of age, or that you are of legal age in your jurisdiction and have given consent for any minor dependants to use this site.

You may not use our products for any unlawful purpose or in breach of any applicable law, including intellectual property legislation.

Section 2 – General conditions

We reserve the right to refuse service to anyone at any time.
You understand that your content (excluding card details) may be transferred unencrypted across networks. Card details are always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell or exploit any part of the Service without our prior written permission.

Section 3 – Accuracy of information

We are not responsible if information made available on this site is inaccurate, incomplete or out of date. The content of the site is provided for general information only.

This does not affect our obligation to provide accurate pre-contract information to consumers, or your statutory rights.

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part of it) at any time and without notice.

Where a price change occurs after you have placed an order, the price confirmed at checkout is the price that applies to that order.

Certain products may be available exclusively online and in limited quantities. Returns and exchanges are subject to our Returns & Refunds Policy.

We make every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that the display on your screen will be entirely accurate.

We reserve the right to limit sales to any person, region or jurisdiction, and to limit the quantities of any product we offer.

Section 6 – Payment and billing

All payments are processed in pounds sterling (£). We accept Visa, Mastercard, American Express and other methods enabled through Shopify Payments.

We reserve the right to refuse any order you place. Orders may be restricted or cancelled where they appear to be suspicious, duplicated, or placed by resellers.

You agree to provide complete and accurate billing and account information for all purchases made in our store.

Section 7 – Delivery

We deliver within the United Kingdom only. Delivery times and conditions are set out in our Delivery Policy.

All orders are shipped Delivered Duty Paid (DDP). You will not be charged customs duties or import taxes on delivery.

Section 8 – Returns and refunds

Our Returns & Refunds Policy forms part of these Terms and applies to all purchases. You have 30 calendar days from the date of delivery to start a return.

This is in addition to your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and your rights in respect of faulty goods under the Consumer Rights Act 2015.

Section 9 – Optional tools and third-party links

We may provide access to third-party tools "as is" and without warranties. Your use of them is at your own risk.

Links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for their content or services.

If you send us suggestions, ideas or feedback, you agree that we may use them at any time without restriction or compensation.

Section 12 – Errors and inaccuracies

There may occasionally be errors in product descriptions, prices, promotions, delivery charges or availability. We reserve the right to correct such errors and to cancel orders where necessary, refunding the full amount paid.

Where a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to supply the product at the incorrect price.

Section 15 – Indemnity

You agree to indemnify and hold harmless PACF Digital Ltd. Co., its affiliates, officers, employees and service providers against any claim arising from your breach of these Terms.

This section does not apply to consumers acting outside the course of a business.

Section 16 – Termination

We may cancel or suspend access to our Services immediately and without notice in the event of a breach of these Terms.

Section 17 – Governing law and jurisdiction

These Terms and any agreements arising from them are governed by the laws of England and Wales.

If you are a consumer resident in the United Kingdom, you may bring proceedings in the courts of the part of the UK in which you live, and you will continue to benefit from all mandatory consumer protections available to you under UK law.

Section 18 – Complaints

If you are unhappy with any aspect of our service, please contact us at supportmontcleaf@gmail.com. We aim to acknowledge complaints within one working day and to resolve them within 14 calendar days.

Section 19 – SMS marketing and notifications

If you provide your telephone number and give your consent, you may receive recurring SMS messages about promotions, order updates and cart reminders. Message frequency may vary. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance.

Section 20 – Entire agreement

These Terms, together with our Privacy Policy, Returns & Refunds Policy and Delivery Policy, constitute the entire agreement between you and Montcleaf.
